If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or
  6. transfer the materials to another person or 'mirror' the materials on any other server.
  7. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

The materials on the School’s website are provided 'as is'. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. HEALTH, FITNESS, AND ASSUMPTION OF RISK — PLEASE READ CAREFULLY

This section applies to all Wellness Mechanics programs, courses, videos, written plans, downloadable guides, assessments, and the Wellness Mechanics training app (the "Programs"), including the Gen X Athleticism Series (Restore, Reinforce, Refine, and Retain). By checking the acceptance box, clicking "I Agree," completing checkout, or accessing any Program, you agree to this section.

NATURE OF THE PROGRAMS. The Programs are self-directed and delivered online, by app, by video, and/or as downloadable materials. Wellness Mechanics does not provide in-person supervision, spotting, or real-time monitoring. You are solely responsible for your training environment, equipment, footwear, and technique, and for deciding whether any exercise is appropriate for you. Wellness Mechanics is an educational and fitness service, not a medical provider, and no medical relationship is created.

NOT MEDICAL ADVICE. Wellness Mechanics content is educational fitness and breathing instruction. It is not medical advice, diagnosis, or treatment, and it does not replace the advice of your physician or other qualified healthcare provider. Always seek qualified advice before starting or changing any exercise, nutrition, or breathing practice.

TALK TO YOUR DOCTOR FIRST. You should consult a physician before beginning this or any exercise or breathing program — especially if you are pregnant or have any heart, lung, blood-pressure, metabolic, neurological, seizure, joint, or other medical condition, are recovering from injury or surgery, or have been inactive for an extended period.

ASSUMPTION OF RISK. Exercise carries inherent and other risks, both foreseeable and unforeseeable, including but not limited to muscle strains, sprains, and tears; joint, tendon, and ligament injuries; back, neck, and spinal injuries; fractures; slips, trips, and falls; cardiovascular events such as elevated heart rate, abnormal blood pressure, fainting, heart attack, or stroke; and in rare cases serious injury, permanent disability, or death. You knowingly and voluntarily assume all such risks, whether caused by the ordinary negligence of Wellness Mechanics or otherwise.

BREATHING DRILLS AND BREATH-HOLDS. Breathing drills and voluntary breath-holds can cause light-headedness or loss of consciousness. NEVER perform them in or near water, while driving or operating machinery, while standing without support, or anywhere a fall or loss of consciousness could cause harm. Practice only in a safe, seated or supported position on a stable surface, and stop immediately if you feel dizzy, lightheaded, or unwell. Do not perform breath-holds without physician clearance if you are pregnant or have cardiovascular, respiratory, neurological, blood-pressure, or seizure conditions.

LISTEN TO YOUR BODY. Stop any movement that causes pain, dizziness, chest discomfort, or shortness of breath, and seek medical attention if needed. Rest when you need to. You are responsible for choosing appropriate loads, intensities, and progressions for your own body.

RELEASE AND WAIVER OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Wellness Mechanics LLC and its owners, members, managers, employees, coaches, contractors, agents, affiliates, and successors (the "Released Parties") from any and all claims, demands, damages, losses, costs, or causes of action — including those arising from the ORDINARY NEGLIGENCE of any Released Party — that arise out of or relate to your participation in, access to, or use of the Programs, whether resulting in personal injury, illness, death, or property damage.

LIMITS ON THIS RELEASE (CALIFORNIA). This release applies to ordinary negligence only. Under California law, including California Civil Code Section 1668, it does not and cannot release the Released Parties from liability for gross negligence, recklessness, willful or intentional misconduct, fraud, violations of law, or violations of public-health-and-safety standards. If any part of this release is held unenforceable, the remainder stays in full force.

INDEMNIFICATION. To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless the Released Parties from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) brought by you or a third party arising out of your participation in the Programs or your breach of these terms, except to the extent caused by a Released Party's gross negligence or willful misconduct.

NO GUARANTEE OF RESULTS. Individual results vary based on starting point, consistency, genetics, and many other factors. No specific fitness, performance, health, or body-composition outcome is promised or guaranteed.

GOVERNING LAW. This section is governed by the laws of the State of California, and any dispute shall be brought exclusively in the state or federal courts located in Orange County, California.

YOUR AGREEMENT. By purchasing, enrolling in, accessing, or using any Wellness Mechanics program, course, content, or app — including by checking the consent box at checkout — you confirm that you are at least 18 years old, that you have read, understood, and agree to this section, and that you participate at your own risk. This acknowledgment has the same effect as a handwritten signature under the U.S. E-SIGN Act and the California Uniform Electronic Transactions Act.

If you do not agree to these terms, do not purchase, enroll in, or use Wellness Mechanics programs or the app.
